State attorney Bill Cervone said Wednesday morning he filed a motion to dismiss charges against UF sophomore defensive end Jermaine Cunningham from his Dec. 5 arrest.
Cunningham was arrested on a misdemeanor battery charge. According to a Gainesville police report, he threw empty soda cups and a sandwich at a Jimmy John's sandwich shop employee.
But Cervone said the charges are being dismissed based on testimony from the victim, who said Cunningham didn't do anything during the incident.
"The victim's testimony was consistent with what Cunningham was telling us, that he didn't do anything," Cervone said
Charges are still pending for former UF linebacker Jon Demps and former LSU wide receiver Xavier Carter, who were also involved in the incident.
